Consignment Agreement
We are so happy to have you join our consignment boutique. By electronically signing this agreement and/or delivering items for consignment, you agree to the terms and conditions below.
Updates to Terms: Modo Boutique may modify these Terms and Conditions at any time at its discretion. It is your responsibility to review the version posted on our website. Each time you consign with us, you accept the then-current Terms and Conditions.
Consent: I (“the Consignor”) have read Modo Boutique’s Consignment Agreement and, by signing, agree to all Terms and Conditions outlined below.
A. Pricing & Selection
- Modo Boutique makes the final selection of items placed on consignment.
- Items not accepted must be picked up within 7 days of notice or they will be donated.
- We set prices based on the current resale market (brand, condition, demand, comps).
- You’ll receive an email with pricing for accepted items; we’re happy to review reasonable changes.
- Markdowns: Items may be reduced by approximately 20% every 30 days on the sales floor.
B. Consignment Period, Fees & Donation Policy
- There is a $1 monthly fee to have items on consignment with Modo Boutique.
- The standard consignment period is approximately 120 days.
- Early returns: Items cannot be returned to the consignor before 60 days without a $10 per-item fee.
- You’ll receive a personal online account to track your consignments.
- At the end of the consignment period, we will email about any remaining items. If not picked up within 7 days, items become the property of Modo Boutique to donate or use at our discretion.
- Payout timing: Payouts can be issued by request once the sold item has passed our 14-day return window.
- Payout fee: $1 per payout request.
- Payouts may be requested via email, our website, phone call, or in person. You can check your balance anytime via your consignor access account.
C. Consignor Earnings (Commission)
Payouts are based on the final sale price:

Modo Boutique’s percentage includes applicable marketplace and payment processing fees (e.g., eBay, PayPal, card processing). We pay the consignor the net proceeds after buyer payment is received and our commission is deducted.
D. Condition of Items
- You may bring items during regular business hours; there is no limit on quantity.
- Items must be clean, odor-free, and in like-new condition (no stains, holes, or excessive wear).
- If dry cleaning or repairs are needed, the cost may be deducted from your account.
- If an item needs to be returned to you, we’ll email you; please pick up within 7 days or it will be donated.
E. Returns (Customer Returns)
- Modo Boutique accepts returns of items sold online and in-store under our posted return policies.
- If a sold item is returned, the sale is reversed and the consignor’s account is debited accordingly.
F. Limitation of Liability
We will take diligent care of consigned items; however, Modo Boutique does not cover losses to consigned property for theft or damage. This includes, without limitation, customer handling, fire, flood, earthquakes, stains, tears, missing parts, shipping damage, or other natural or man-made causes.
G. Inactive Account
After two (2) consecutive years of inactivity on the consignor’s account, any unclaimed accrued balance is forfeited and Modo Boutique has no obligation to issue payment.
H. Ownership, Authenticity & Dispute Resolution
- You represent and warrant that you own the items consigned (or are authorized to consign them) and that all items are authentic (no counterfeits).
- You agree to indemnify Modo Boutique for any damages, penalties, fines, fees, or judgments arising from ownership or authenticity disputes.
- All disputes will be resolved by binding arbitration in Portland, Oregon under American Arbitration Association (“AAA”) rules. The prevailing party is entitled to reasonable attorneys’ fees and arbitration costs.
This Agreement replaces all prior consignment agreements or verbal discussions between the Consignor and Modo Boutique in their entirety.
